About this Privacy Statement

This Job Applicant Privacy Statement (the “Privacy Statement”) explains how IREN Limited and its affiliates (collectively “IREN”, “us” or “we”) collect, process, use, hold, communicate and disclose personal information (defined below) relating to you (“you”) as part of our recruitment and selection process, including if you are applying for employment with us through https://iren.com or any other IREN website (“the “Websites”), or through a third party or third party website. If you provide personal information to us in another context, such as in an investor context, then please refer to our general privacy policy available at https://iren.com/legal/privacy-policy (“General Privacy Policy”). If you are a California resident, Schedule A of this Statement also applies.

IREN is the data controller of your personal information for the processing activities described in this Privacy Statement.

BY PROVIDING ANY PERSONAL INFORMATION TO US, YOU ACKNOWLEDGE AND UNDERSTAND THAT WE WILL PROCESS YOUR PERSONAL INFORMATION (AND, TO THE EXTENT AGREEMENT TO THIS PRIVACY STATEMENT IS REQUIRED BY APPLICABLE DATA PROTECTION LAW, YOU AGREE TO THE PRACTICES AND POLICIES AS DESCRIBED IN THIS PRIVACY STATEMENT).

1. Personal Information and Sensitive Information

“Personal information” means information about an identifiable individual. Personal information includes information such as names and email addresses. Personal information does not include data where the identity of the individual has been removed (anonymous data) including where this is aggregated with other user data (aggregate user data). “Sensitive information” is a subset of personal information and (a) includes “sensitive information” as defined under applicable law and (b) includes (as applicable) (i) Social Security numbers or other government-issued identification numbers; (ii) protected health information subject to the Health Insurance Portability and Accountability Act of 1996 (US) or other information regarding an individual’s medical history, mental or physical condition, or medical treatment or diagnosis by a healthcare professional; (iii) health insurance information; (iv) biometric information; (v) data relating to criminal convictions and offences or related security measures information; or (vi) any other information that falls within any special categories of personal data (as defined in applicable data protection laws), or similar term defined in applicable data protection laws.

2. What personal information do we collect?

We may collect and process the following personal information (with your consent, where required by law):

  • Contact Information, such as your name, address, telephone number, e-mail address and other contact details such as social media handles you use on recruitment websites;
  • Job Application Information, such as your resume/curriculum vitae, cover letter, employment history, educational background, professional qualifications, and languages spoken;
  • Employment Eligibility Information, such as information to establish or confirm your identity and information related to your eligibility to work such as your date of birth, nationality, health screening information relating to your physical ability to perform certain job functions, and where applicable, government-issued identification numbers to demonstrate proof of work eligibility and background check reports (such as, verification of education, and professional background, criminal record check, and other relevant information, subject to IREN policies and applicable laws);
  • Assessment Information about you, such as interview notes and test results;
  • Communication Information, such as our correspondence during the recruitment process;
  • Device Information, details of your visits to our Websites and information collected through cookies and other tracking technologies including, but not limited to, your IP address, domain name, your browser version and operating system, traffic data, location data, web logs and other communication data, visits from referral websites and communications, and the resources that you access; • Online Information, such as publicly available information available on social media or other online resources where your personal information is made publicly available, subject to IREN policies and applicable law;
  • Compliance Information, including any information we reasonably require to establish, manage and/or terminate our relationship with you or to comply with law; and
  • Other Information, including any information relating to you which you or third parties (e.g. referees and recruiters) may provide, or which we may create as part of the records we maintain in connection with our recruitment and selection processes.

Sensitive information may be required to be collected in some circumstances. We will only collect sensitive information if it is necessary for our business purposes. Sensitive information will only be collected with your consent, unless an exception applies under applicable data protection law.

Sometimes we need to collect certain types of personal information to comply with our legal obligations, and if that’s the case, that will be explained to you when it is requested.

To assist us to keep our records up to date, please ensure all personal information you provide to us is accurate and up to date, and notify us of changes where appropriate.

If you do not provide your personal information, we may be unable to progress your application or offer of employment, or consider you for future job opportunities. If you do not want to be considered for other positions or would like us to remove your personal information, you may contact us as specified below in the “Contact Us” section.

3. How do we collect your personal information?

When collecting personal information from you, we may use various sources, including:

  • Websites, through your access to and use of our Websites or job board websites not operated by us, including when you complete forms or upload documents to those websites;
  • Screenings and interviews, such as during conversations between you and our representatives; • Communications, such as when you communicate with us via email, post or phone; • Prior employers that provide us with employment references;
  • Professional references that you authorize us to contact; • Pre-employment screening services, such as background check providers (where permitted by law);
  • Employment agencies and recruiters;
  • Your educational institutions;
  • Your public social media profile (e.g. LinkedIn) or other publicly available sources; or
  • Other IREN personnel.

We may also collect personal information about you from publicly available sources, such as your publicly available social media profiles, and from third parties, including recruiters or service providers who assist us with our recruitment activities, your authorized representatives and your referees, if it is necessary for our business purposes either with your consent or as otherwise permitted under applicable data protection law.

4. For what purposes do we collect, use, hold, process, communicate and disclose your personal information?

We collect, use, hold, process, communicate and disclose your personal information for some or all of the following purposes.

Certain applicable data protection law requires IREN to establish a “lawful basis” to justify the purposes. These are noted below:

  • administering our relationship with you, which may include assessing your suitability for a job you have applied for, to match you with other job vacancies at IREN and preparing for you to start employment with us

  •  to verify your identity and eligibility to work;

Lawful basis: legal obligations where required by law. In all other cases, legitimate interests (so that you fall within our acceptable risk profile). Where this involves the processing of sensitive information, the legal basis we generally rely on is that the processing is in the substantial public interest;

  • statistical reporting and analysis in relation to recruitment;

  •  meeting legal or other regulatory obligations imposed on us

Lawful basis: compliance with legal obligations. Where this involves the processing of sensitive information the legal basis we generally rely on is that the processing is in the substantial public

interest or legal claims;

  •  maintaining and updating our records, and keeping your contact details up to date

  •  to present our Websites’ content in a secure and effective manner for you and for your device

We do not sell or rent your personal information.

We may use certain automated decision-making technologies as part of our recruitment process, including to review candidates’ application materials and prioritize them for review by our recruiters. We may use automated filters to remove candidates from consideration where the candidate does not meet basic qualification requirements for the relevant job, such as legal working age, eligibility to work in the jurisdiction, and possessing licenses or similar requirements for the job.

5. Whom do we disclose your personal information to?

While we treat your personal information as confidential, we may disclose your personal information to the recipients set out below for the purposes (and lawful basis) described above, each on a needs-to-know basis:

  • Our personnel, such as our employees, related entities and contractors;
  • Affiliates, such as our corporate parent, subsidiaries, and other affiliates under the control of our corporate parent, for purposes consistent with this Privacy Statement or to operate shared infrastructure, systems and technology;
  • Company service providers, such as our business partners and/or third party service providers in connection with our recruitment and selection processes. As examples, we may use service providers to host our job vacancies and assist us with our recruitment activities such as background checks and online assessments;
  • Government authorities, law enforcement and others, such as government authorities, law enforcement, courts, the Securities and Investments Commission and others where required by law.
  • Business transfer participants, such as parties (and their advisors) to transactions and potential transactions pursuant to which we sell or transfer some or all of our business or assets, including your personal information, such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution;
  • Professional advisors, such as lawyers, immigration advisors, and other outside professional advisors who require your information in the course of providing their services; and
  • Other parties not listed above, including any other organisation or individual, including governmental bodies, for any authorised purpose as permitted by applicable data protection laws.

In addition, we may disclose your personal information where required to do so by law, such as in connection with our reporting obligations, any legal proceedings or prospective legal proceedings, law enforcement purposes, or to establish, exercise or defend our legal rights including providing information to others for the purposes of fraud prevention. Sometimes at the end of the recruitment process, and in compliance with applicable laws, we may seek your consent to disclose your personal information to third parties who assist us with our compliance obligations (in relation to the job you are being engaged to perform), including the completion of background checks.

6. Overseas transfers of personal information

Certain of our disclosures of your personal information may be to recipients (including global service providers) located outside of the jurisdiction from which your personal information was originally collected or from which you are located, including Canada, the United States and Australia. 7. Minors

We do not knowingly collect personal information from children under the age of 16. If a child under 16 has provided us with personal information without the consent of an appropriate adult under applicable law, such as a parent or guardian, then the parent or guardian may contact us by emailing us at privacy@iren.com.

8. Security and data retention

Personal information held by us will be stored and secured in accordance with our General Privacy Policy.

If you are offered and accept employment or a contractor role with us, the personal information we collect during the application and recruitment process will become part of your employment or contractor record (as applicable), and we may process, use, hold, communicate and disclose it in connection with your employment or engagement as a contractor consistent with our employee and contractor privacy policies. If you do not become an employee or contractor or, once you are no longer an employee or contractor of IREN, we will retain and securely destroy your personal information in accordance with our General Privacy Policy.

9. Cookies and similar technologies

IREN uses cookies and similar tracking technologies to collect and maintain statistics relating to the number of visits to the Websites, to analyse trends, to track your movements to our Websites from referring websites and other communications, as well as around our Websites, to record information about your visit to help build a profile of you and your approximate geographic location and to understand our recruiting streams, such as whether you found us through an online job board, and if so, which one.

Because we link to social media sites, and from time to time may include third party advertisements, other parties may collect personal information about your online activities over time and across different websites when you visit our Websites.

You may take certain steps to limit the information available to us through these technologies, including:

Cookies and other technologies. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Blocking images/clear gifs: Most browsers and devices allow you to configure your device to prevent images from loading. To do this, follow the instructions in your particular browser or device settings.

Global Privacy Control and Do Not Track. Some Internet browsers may be configured to send the Global Privacy Control or “Do Not Track” signals to the online services that you visit. We may change this Privacy Statement at any time and from time to time. We will make updates available. When we do so, we will provide appropriate notice to you, including by publishing a new version on our Websites. We will update the date it was last changed above. Any change will be prospective only, and we will not make any changes that have retroactive effect unless legally required or permitted to do so.
